Terms of Service

These terms cover your use of deskowls.com and the DeskOwls service. DeskOwls is operated by Rob Stone in Belen, New Mexico, USA. By using the site or the service, you agree to them. Questions go to hello@deskowls.com.

The service

DeskOwls sets up and runs AI voice receptionists, missed-call text-back, lead follow-up and appointment booking for service businesses. What's included in your plan is set out on our pricing section or in what we agree with you in writing.

Trials and billing

Where we offer a trial or pilot, its length and terms are as stated when you sign up. Paid plans are billed monthly in advance, with no long-term contract. You can cancel at any time, and the service runs to the end of the period you've paid for. Fees already paid aren't refunded unless we agree otherwise in writing.

Your responsibilities

Call recording and consent. Some states require everyone on a call to consent to recording. You're responsible for making sure the way you use DeskOwls, including recording and any greeting or disclosure, complies with the laws that apply to you and your callers.
Text messaging. You'll only ask us to text people who have given the consent the law requires, and you'll honour opt-outs.
Accurate information. You'll give us accurate details about your business, services, prices and availability, and tell us when they change.
Lawful use. You won't use DeskOwls for spam, harassment, fraud or anything unlawful.

What an AI receptionist can and can't do

Our AI receptionist is good at answering, qualifying and booking, but it can mishear, misunderstand or make mistakes, and it depends on third-party phone, AI and calendar services that can occasionally fail. Please check bookings and messages as part of running your business. DeskOwls is not an emergency service. Anyone with an emergency should call 911.

Our providers

DeskOwls runs on third-party services such as telephone and text providers, AI voice and language models, and calendar software. We're not responsible for outages or changes on their side, but we'll do what we reasonably can to keep your service running.

Liability

To the extent the law allows, DeskOwls isn't liable for lost profits, lost jobs or indirect losses, and our total liability for any claim is limited to the fees you paid us in the three months before it arose.

Ending the service

You can cancel at any time. We can suspend or end the service if these terms are broken, if payment isn't made, or if continuing would break the law.

Governing law

These terms are governed by the laws of the State of New Mexico, USA.

Changes

We may update these terms. If we do, we'll change the date at the top of this page. Continuing to use the service after a change means you accept the updated terms.
